Terms of Service

1. Who these terms apply to

These Terms of Service ("Terms") apply to anyone who accesses or uses AuraWORKS ("the Service"), operated by AuraWORKS ("we", "us"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

AuraWORKS is cloud-based software for boutique and tailor shop management. It includes order management, customer records, measurement storage, worker payment tracking, billing, and reports. We may add, change or remove features at any time, and will tell users about significant changes.

3. Your account

• You must provide accurate information when creating an account.
• You are responsible for keeping your login credentials secure.
• You are responsible for all activity that happens under your account.
• You must be 18 years or older to create an account.
• One subscription covers one shop or business location. Enterprise arrangements may cover multiple locations, as set out in your plan.

4. Subscriptions and payment

• AuraWORKS is sold as an annual subscription. Payment is due at the start of each subscription year.
• Prices are quoted in Indian Rupees (INR) inclusive of applicable taxes.
• Subscriptions do not auto-renew without your explicit consent. We will remind you before renewal is due.
• Refunds: if the software does not work as described and we are unable to resolve the issue within 14 days, we will offer a pro-rata refund for the remaining subscription period. Refunds are not available for change of mind after 14 days of first use.

5. Acceptable use

You agree not to:

• Use AuraWORKS for any unlawful purpose or in violation of any applicable Indian law
• Attempt to gain unauthorised access to any part of the Service or its infrastructure
• Reverse engineer, decompile or copy any part of the software
• Resell or sublicense access to AuraWORKS to third parties
• Enter false, misleading or harmful data into the Service
• Use the Service to store or transmit content that is illegal, defamatory, or infringes intellectual property rights

6. Your data

You own all data you enter into AuraWORKS: customer records, orders, measurements, and business records. We hold this data as a processor on your behalf. We do not sell it or use it for any purpose other than providing the Service. See our Privacy Policy for full details.

You can export your data at any time. On account closure, we delete your data within 30 days of a written request.

7. Service availability

We aim for high availability and take reasonable steps to prevent downtime. However, we do not guarantee that the Service will be available all of the time. We are not liable for losses caused by interruptions beyond our reasonable control, including internet outages, server failures, or force majeure events.

Planned maintenance will be announced in advance where possible. Emergency maintenance may happen without notice.

8. Intellectual property

AuraWORKS, including its code, design, branding and content, is owned by us and protected by applicable intellectual property law. These Terms do not transfer any ownership to you. You receive a limited, non-exclusive licence to use the software for the duration of your subscription.

9. Limitation of liability

To the maximum extent permitted by Indian law, AuraWORKS is not liable for indirect, incidental, or consequential losses arising from use of the Service, including loss of business data, revenue or profits. Our total liability for any claim related to the Service shall not exceed the amount you paid for your current subscription year.

10. Termination

You may cancel your subscription at any time by contacting us. We may suspend or terminate accounts that violate these Terms, with or without notice depending on the severity of the breach. On termination, your access to the Service ends and we follow the data deletion process described in our Privacy Policy.

11. Changes to these Terms

We may update these Terms from time to time. Significant changes will be communicated by email at least 14 days before they take effect. Continued use of the Service after changes take effect means you accept them.

12. Governing law

These Terms are governed by the laws of India. Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of India.
